Terms & Conditions
It is essential that all clients read and sign these terms & conditions for all Encore bookings. All bookings are subject to these terms & conditions although Encore Dance Entertainment reserves the right to negotiate within the structure of these terms & conditions.
Bookings
All clients shall complete and sign a contract agreeing to the details of the event. A deposit of 20% of the total amount shall be paid with the completion of the contract. The balance of the account shall be paid to the Encore Dance Entertainment representative before comencement of the event.
Provisional Bookings
Provisional bookings will be automatically cancelled if they are not confirmed in writing within 7 days of the initial enquiry.
Weather Permitting Bookings
Cancellation will incur a half fee charge provided that a minimum of 2 hours notice of intent is given. However, if the artiste or group arrives at the location, without the stated notice of intent, the full fee will be chargeable.
Fees
Subject to agreement, all fees are based on the quoted daily or hourly rate. Extra hours or parts thereof shall be charged at the hourly rate. Agreed expenses shall be added where appropriate. All daily fees are based on an eight hour day which includes a lunch break comprising of 1 hour (Shops Act 1950).
Overtime is charged at the quoted hourly rate. For bookings between midnight and 9am a special rate is to be negotiated.
Dancers & Shows
Subject to agreement, all fees are negotiated on an individual basis. Extra hours outside of the agreement are charged at the quoted hourly rate. For bookings between midnight and 9am a special rate shall be negotiated. Agreed expenses will be added where appropriate.
All fees are to be negotiated through Encore Dance Entertainment only.
Bespoke Costumes
Subject to agreement, all fees are negotiated on an individual basis. If a client has requested the manufacture of a bespoke item to be used during their event a fee is chargeable. This fee shall be paid, upon signing of the contract. All items remain the property of Encore Dance Entertainment unless otherwise previously agreed in writing.
Payment Terms
A deposit of 20% of the total amount shall be paid on signing the contract. A full and final invoice shall be submitted prior to the event, at which time the balance of the account shall be settled, unless otherwise stated in writing.
In all cases the person booking the artiste or group shall be invoiced and solely responsible for payment, unless otherwise agreed at the time of booking.
Insurance
The client is responsible for the health and safety of the artiste or group when they are traveling, or providing services in connection with the booking to the same extent as if they were an employee of the client. The client shall maintain adequate insurance cover to underwrite its obligations to the artiste or group.
Encore is not responsible if the artiste or group fails to attend the booking. The client is advised to insure against any loss which might result if the artiste or group does not keep a booking because of ill health or any other reason.
Usage
An additional fee is payable for the use of any photographs or reproductions other than those previously permitted. Unless otherwise agreed the permitted use is for editorial, or press advertising and excludes posters, internet, promotional and display material. It is not permitted to use photographs for any purpose whatsoever until all fees have been agreed or paid. The client is responsible for negotiating the additional fee payable for posters, promotional and display material at the time of booking.
Travel & Accommodation
Travel outside a 5 mile radius of Newcastle upon Tyne shall be charged at half the hourly rate. Travel expenses are charged as standard class return rail fare, or economy return air fare. Additional transportation from and to any station or airport shall be provided and paid for by the client to the required location in advance.
Hotel accommodation shall be provided when bookings are outside the UK or at a distance within the UK considered too great to make day return travel realistic. Encore reserves the right to inspect and approve all travel documentation prior to the proposed event.
Cancellations
PR & Hostessing
If a booking is cancelled within 1 working day of the start time then the full fee will be charged. If a booking is cancelled outside the one-day period, but within two working days but less than 1 working day of the start time, then a half fee charge shall be incurred. Cancellation prior to 2 working days of the start time shall incur no charge. Saturdays, Sundays and Bank Holidays are excluded when calculating cancellation periods.
Dancers & Shows
If a booking is cancelled within 7 days of the start time the full fee shall be paid. If the show is cancelled within 14 days of the start time, the deposit will be lost. Cancellation prior to 14 days of the start time will incur no charge.
Bespoke Costumes
Subject to the agreement, all fees charged for bespoke items are non refundable.
Complaints
Any complaint shall be reported to Encore Dance Entertainment during the course of the booking.
